Estate Planning

At Peters & Krown, we help clients protect what they have built and plan for the orderly transfer of assets. Estate planning is not a one-size-fits-all process. Each plan should reflect the client's unique family dynamics, assets, and long-term objectives. We work directly with our clients to develop plans that are both practical and tailored to their specific circumstances.

Our Estate Planning Practice

We advise clients across a range of estate planning needs, from foundational documents to more complex planning strategies. Whether you are creating a plan for the first time or updating an existing one, we provide guidance throughout the process.

Our standard services include:

  • Wills: A will directs how assets pass through probate and allows you to nominate personal representatives of your estate, and guardians for minor children.
  • Trusts: Trusts are often used to avoid probate, maintain privacy, plan for incapacity, and structure distributions over time. We draft revocable and irrevocable trusts, including specialized trusts where appropriate, based on each client's unique goals.
  • Powers of Attorney: A power of attorney authorizes a trusted individual to act on your behalf in financial or legal matters in you are unable to do so yourself. Proper drafting helps ensure continuity and avoids unnecessary court involvement.
  • Advance Directives: An advance directive, also known as a living will or healthcare directive, sets out your preferences for medical care and end-of-life decisions, and designates the individual authorized to make those decisions.

Comprehensive Planning

For many clients, estate planning extends beyond basic documents. We regularly assist with more advanced considerations, including:

  • asset protection strategies
  • estate and gift tax planning
  • business succession planning
  • planning for blended families
  • planning for a family cabin
  • generational trust planning
  • special needs planning
  • charitable planning
  • planning for digital assets and non-traditional planning

Flat Rate Pricing

We offer estate planning services on a flat fee basis to provide clarity and predictability. Our flat fee depends on the document package being requested, the nature of the assets involved, and the level of customization required to achieve the client's wishes.

During your initial consultation with our attorneys, they will outline available planning options, make recommendations based on your situation, and provide a clear fee quote for the work required. This allows you to make an informed decision before moving forward, and have clear expectations throughout the process.

Estate Planning Review and Updates

Estate planning is not a one-time event, but rather an ongoing process that requires periodic review and updates to ensure that your plan reflects your current wishes and goals. Life events such as marriage, divorce, the birth of a child, or the purchase of a new asset can all impact your estate plan. Estate planning and tax laws often change over time as well, and can carry significant implications for an estate plan. Our attorneys can review your existing estate plan and make recommendations for updates or changes to ensure that it reflects your current circumstances and current law.

New Montana Residents

If you are a new Montana resident, it's important to review and update your estate plan with an attorney to ensure that it complies with Montana state law. Montana has unique laws and it's important to have an estate plan that reflects these laws. Our attorneys can provide legal advice and guidance to new Montana residents to help them create an estate plan that meets their unique needs and complies with Montana state law.
